La gestación por sustitución y su regulación en el derecho penal

Abstract

[ES] El problema tanto social como jurídico que plantea la gestación por sustitución suscita múltiples interrogantes en el Derecho. En este trabajo nos centraremos en la rama del Derecho Penal y en la poca intervención que posee sobre esta cuestión en el ordenamiento jurídico español. Examinaremos la actual regulación de este fenómeno tan controvertido, al igual que debatiremos sobre la viabilidad de permitir o regular esta figura jurídica en España. ¿Se tiene que prohibir la gestación por sustitución? y en tal caso, ¿merece ser castigado por el Código Penal? o, por el contrario, ¿ha llegado el momento de que España acuerde un marco normativo que apruebe y controle estos sucesos? En las próximas páginas daremos respuestas a estas preguntas.

[EN] The social and legal problems posed by gestational surrogacy raises many questions in law. In this paper we will focus on the branch of Criminal Law and the little intervention it has on this issue in our Spanish legal system. We will examine the current regulation of this controversial phenomenon, as well as we will debate on the feasibility of allowing or regulating this legal figure in Spain. Should surrogacy be prohibited and, if so, does it deserve to be punished by the Penal Code or, on the contrary, has the time come for Spain to agree on a regulatory framework that approves and controls these events? In the next pages we will give answers to these questions.
