El derecho penal en las dictaduras del Siglo XX: análisis comparado de la reincidencia en Italia y España

Abstract

[ES]Las dictaduras europeas emergentes constituyeron una amenaza al orden liberal y democrático del momento, imponiendo su ideología a todo pensamiento contrario al Régimen, incluyendo el Derecho Penal, en el cual se veían reflejados estos valores. Desde esta perspectiva, se van a estudiar las diferentes doctrinas que preceden estos movimientos totalitarios, centrando su atención en la figura tipificada de la reincidencia, sus formas y su tratamiento dentro de los textos legales que estuvieron vigentes durante el periodo fascista y franquista. Se llevará a cabo una visión de la codificación actual en ambos países y un enfoque hacia la situación futura de la reincidencia y los reincidentes.

[EN]Emerging European dictatorships constituted a threat to liberal and democratic order of that time, imposing their ideology every over thought contrary to the regime, including Criminal Law, in which these values were reflected. From this perspective, it will study the various doctrines that precede these totalitarian movements, focusing on the standardized figure of recidivism, its forms and its treatment within the legal texts that were in effect during the fascism and Franco dictatorships. It will be held a vision of the current encoding in both countries and a focus on the future status of recidivism and repeat offenders.
