Consejo General del Poder Judicial: un bloqueo analizado desde su histórica politización

[spa] El Consejo General del Poder Judicial fue creado a través de la Constitución Española de 1978 como órgano de gobierno del Poder Judicial, y tiene como función principal la de garantizar la independencia de los Jueces y Magistrados respecto al resto de poderes del Estado. Por desgracia, desde su creación las disputas en relación con su sistema de elección han sido constantes entre partidos políticos, asociaciones judiciales y demás poderes del Estado. De este modo, el Consejo ha sido un órgano que se ha visto envuelto por una gran politización e intentos de injerencia por parte del resto de órganos y poderes estatales, lo cual ha provocado una gran dificultad para poder cumplir con su principal cometido. Todo ello ha llevado al Consejo a la situación que vive hoy en día, donde sufre un bloqueo y falta de renovación que se alarga ya durante más de tres años, en los que continúa ejerciendo en funciones, y lo que es más grave, una gran deslegitimación entre la población, que pone en cuestión la independencia, tanto de los miembros del Consejo, como de los del Poder Judicial. A través del presente trabajo expondremos las causas que han llevado al Consejo General del Poder Judicial hasta la situación que vive en la actualidad y los principales efectos de la misma, poniendo especial énfasis en las modificaciones del sistema de elección y en la politización que ha vivido la institución.

[eng] The General Council of the Judiciary was created by the Spanish Constitution as the governing body of the Judiciary, and its main function is to guarantee the Independence of Judges and Magistrates with respect to the other branches of government. Unfortunately, since its creation, disputes over its election sistema have been constant between political parties, judicial associations and other branches of government. In this way, the Council has been a body that has been involved in a great deal of politicization and attempts of interference by the rest of the state bodies and Powers, which has made very difficult for it to fulfill its main misión. All this has led the Council to the situation it is in today, where is suffering from a blockage and lack of renewal that has lasted for more tan three years. And what is more serious, it is suffering a great lack of legitimacy among the population, which calls into question the Independence of the members of the Council and the members of the Judiciary. Through the present work we will expose the causes that have led the Judiciary to this situation, and its main effects, with special emphasis on the modifications of the election system and on the politicization that institution has undergone.
