dc.description.abstract | [ES]En el presente trabajo se tratará de analizar lo ocurrido en España durante la pandemia COVID-19 con las medidas
adoptadas tanto por el poder público para afrontarla, como también por el control realizado por el poder
jurisdiccional al respecto. Principalmente, se estudiará lo concerniente a la definida y ya conocida como limitación
de los derechos fundamentales y de las libertades de los ciudadanos, junto con la polémica acerca de si se limitaron o
se suspendieron temporal y/o parcialmente los mismos. Para ello se examinarán las declaraciones y las prórrogas de
los diferentes estados de alarma adoptados a lo largo de la pandemia mundial del COVID-19 en España. Así mismo,
se hará especial hincapié en las principales sentencias de los tribunales, ya sean del Tribunal Constitucional
(recalcando los votos particulares de los magistrados), Tribunal Supremo o incluso de las propias sentencias de los
Tribunales Superiores de Justicia de algunas comunidades autónomas, las cuales tuvieron una importancia
considerable. Una vez conocidos y entendidos los diferentes fallos judiciales relacionados con la limitación y/o la
suspensión de los derechos fundamentales, se acudirá en última instancia a la doctrina entendida en la materia para
comprobar de primera mano las opiniones al respecto, junto con las posibles alternativas que propongan. | es_ES |
dc.description.abstract | [EN]In this work, we will try to analyze what happened in Spain during the COVID-19 pandemic with the measures
adopted both by the public power to deal with it, by the public power to deal with it and by the control carried out by
the jurisdictional power in this regard. Mainly, what concerns the defined and already known limitation of the
fundamental rights and freedoms of citizens will be studied, together with the controversy about whether they were
temporarily and/or partially limited or suspended. For this, the declarations and extensions of the different states of
alarm adopted throughout the global pandemic of COVID-19 in Spain will be examined. Likewise, special emphasis
will be placed on the main judgments of the courts, whether they are from the Constitutional Court (emphasizing the
particular votes of the magistrates), the Supreme Court or even the judgments of the Superior Courts of Justice of
some autonomous communities, which had considerable importance. Once the different judicial decisions related to
the limitation and/or suspension of fundamental rights are known and understood, the knowledgeable doctrine in the
matter will ultimately be used to verify first-hand the opinions in this regard, along with the possible alternatives that
