El mecanismo de la segunda oportunidad en el Texto Refundido de la Ley Concursal

Abstract

[ES] El beneficio de exoneración del pasivo insatisfecho otorga a los deudores de buena fe la posibilidad de verse exonerados del pago de las deudas que quedarán pendientes al finalizar el concurso por liquidación o por insuficiencia de masa. En el presente trabajo se realiza un estudio de esta figura a la luz de la nueva regulación contenida en el RDL... prestando especial atención a las cuestiones más polémicas y dudosas de la regulación.

[EN] The BEPI grants debtors in good faith the possibility of being exonerated from the payment of debts that they would otherwise be forced to pay after the conclusion of the bankruptcy process by liquidation or insufficiency of assets. In the present work we study this figure in the light of the new regulation contained in the RDL 1/2020, from the 5th of may, paying special attention to the most controversial and doubtful questions of the regulation.
