La diversidad de regulaciones sobre los vientres de alquiler entre los Estados ha provocado inevitablemente la internacionalización de esta práctica, ya que los padres y/o madres «intencionales» cuya ley nacional es más restrictiva se ven obligados a viajar a otro país donde este método sí es legal. Este es el caso de los residentes españoles, puesto que, en nuestro país, los contratos de gestación por sustitución son nulos de pleno derecho y rige la regla mater semper certa est, considerándose que «es madre la que pare». Esta regulación legal convive con una Instrucción de la Dirección General de los Registros y del Notariado, que permite inscribir en España, previa resolución judicial del país de origen, a los bebés nacidos a través de esta práctica. De esta forma, los padres y/o madres «intencionales» son reconocidos como padres y/o madres legales. En suma, el fin último de este Trabajo de Fin de Grado es respaldar la idea de que en España se está cometiendo un fraude de ley, tal y como queda definido en el artículo 6.4 del Código Civil, y una «huida» del ordenamiento jurídico español.
