Violencias, explotación y desprotección en las mujeres extranjeras: una travesía por los sistemas de dominación a través del caso de Ahlam

[ES] A través del caso concreto de Ahlam, se examina la odisea de violencias y violaciones de derechos humanos que puede suponer para una mujer racializada la migración a España. El estudio se enfoca en el análisis de algunos de los contextos de violencia por los que pasan miles de mujeres inmigrantes que emigran para trabajar y lograr unas condiciones de vida dignas, desde el planteamiento de la existencia de intersecciones entre sistemas de opresión como el capitalismo, el patriarcado, la colonialidad y el racismo que impactan en las vidas de estas mujeres de forma directa. Se analiza y visibiliza la realidad laboral precaria y degradante que sufren en diversos sectores, el riesgo a ser víctimas de trata de personas, así como el alcance del Derecho a la hora de hacer frente a estos fenómenos a través de la normativa internacional, europea y estatal. Se destaca cómo el estatus migratorio, el género y la clase social afectan a la susceptibilidad a sufrir violaciones de derechos. La trata de seres humanos y la explotación laboral se contextualizan dentro del sistema económico neoliberal y el régimen de extranjería, que interacciona con otros sistemas de opresión. El siguiente trabajo se realiza propone a través de la Clínica Jurídica por la Justicia Social de la UPV/EHU, con la colaboración de la entidad SOS Racismo Gipuzkoa. Lan egiteko eta bizi-baldintza duinak lortzeko emigratzen duten milaka emakume etorkinek igarotzen dituzten indarkeria-testuinguruetako batzuen azterketan oinarritzen da azterlana, emakume horien bizitzetan zuzenean eragiten duten zapalkuntza-sistemen (kapitalismoa, patriarkatua, kolonialtasuna eta arrazakeria) arteko elkarguneak daudela planteatuz. Hainbat sektoretan pairatzen duten lan-errealitate prekarioa eta apalesgarria, pertsonen salerosketaren biktima izateko arriskua eta fenomeno horiei nazioarteko, Europako eta Estatuko araudiaren bidez aurre egiteko Zuzenbidearen irismena aztertu eta ikusarazten dira. Migrazio-estatusak, generoak eta gizarte-klaseak eskubide-urraketak pairatzeko arriskuan nola eragiten duten nabarmentzen da. Gizakien salerosketa eta lan-esplotazioa sistema ekonomiko neoliberalaren eta atzerritartasun-erregimenaren testuinguruan kokatzen dira, beste zapalkuntza-sistema batzuekin elkarreraginean. Hurrengo lana UPV/EHUko Justizia Sozialaren aldeko Klinika Juridikoaren bidez proposatzen da, SOS Arrazakeria Gipuzkoa erakundearen lankidetzarekin. [EN] Through the specific case of Ahlam, it examines the odyssey of violence and human rights violations that migration to Spain can entail for a racialised woman. The study focuses on the analysis of some of the contexts of violence that thousands of immigrant women who migrate to work and achieve decent living conditions go through, from the perspective of the existence of intersections between systems of oppression such as capitalism, patriarchy, coloniality and racism that have a direct impact on the lives of these women. It analyses and makes visible the precarious and degrading labour reality they suffer in different sectors, the risk of being victims of human trafficking, as well as the scope of the law when dealing with these phenomena through international, European and state regulations. It highlights how migration status, gender and social class affect susceptibility to rights violations. Human trafficking and labour exploitation are contextualised within the neoliberal economic system and the alien regime, which interacts with other systems of oppression. The following work is proposed through the Legal Clinic for Social Justice of the UPV/EHU, with the collaboration of the organisation SOS Racismo Gipuzkoa.
