The Palestinian genocide under the eyes of the ICJ and the ICC

Abstract

[EN] The Palestinian people have been victims of the Israeli military offensive for the past 75 years, but since October 2023 this ethnic cleansing has now evolved into a widespread genocide. This paper will try to demonstrate that what the Israeli soldiers are doing in the Gaza Strip is nothing but a textbook example of genocide. First, it will shortly address the historical background of the two most important courts internationally, the International Court of Justice (ICJ) and the International Criminal Court (ICC). After that, the procedural analysis of both judiciary bodies will give insight into how each of them functions, and more importantly, which barriers and obstacles Palestine faces before them. Finally, the last sections of the paper will support the position that there is a genocide taking place in Gaza, concluding with critical reflexions about the current scene and the role of the international community.

[ES] El pueblo palestino ha sido víctima de la ofensiva militar israelí durante los últimos 75 años, pero esta limpieza étnica se ha convertido ahora en un genocidio generalizado desde octubre de 2023. Este trabajo intentará demostrar que lo que los soldados israelíes están haciendo en la Franja de Gaza en estos momentos no es más que un ejemplo de genocidio de manual. En primer lugar, se abordarán brevemente los antecedentes históricos de los dos tribunales más importantes a nivel internacional, la Corte Internacional de Justicia (CIJ) y la Corte Penal Internacional (CPI). Después, el análisis procesal de ambos órganos judiciales permitirá comprender cómo funciona cada uno de ellos y, lo que es más importante, qué barreras y obstáculos afronta Palestina ante ellos. Finalmente, las últimas secciones apoyarán la posición de que en Gaza se está produciendo un genocidio, aportando la suficiente evidencia, concluyendo con reflexiones críticas sobre el escenario actual y el papel de la comunidad internacional.
