El bien jurídico de los sentimientos religiosos en el actual marco constitucional

Abstract

[ES] El objetivo de este trabajo es analizar el fundamento constitucional del bien jurídico de los sentimientos religiosos y, asimismo, examinar la necesidad de intervención penal en estos casos. Así pues, en primer lugar estudiaremos la evolución legislativa del concepto de los sentimientos religiosos en España. A continuación, pasaremos a analizar el bien jurídico de los sentimientos religiosos en la Constitución de 1978. Junto con esto, analizaremos los delitos de profanación y escarnio previstos en los artículos 524 y 525 del Código penal. Posteriormente trataremos de determinar el fundamento constitucional de este concepto a la luz de la doctrina y la jurisprudencia. Finalmente, haremos referencia al debate en la doctrina sobre la necesidad de mantener estos delitos.

[EN] The purpose of this work is to analyze the protected right of religious feelings and its legal basis, and also examine the justification for criminal intervention in these cases. That being said, I will first study the legislative evolution of the concept of religious feelings in Spain. Next, I will move on to analyze the protected right of religious feelings according to the Spanish Constitution from 1978. Along with this, I will also examine the offenses of desecration and derision foreseen in articles 524 and 525 of the Spanish Criminal Code. Later on, I will try to determine the legal basis for the concept of religious feelings in light of the doctrine and jurisprudence. At last, I will study different authors’ opinions to find out whether there is room in penal law for these offenses.
